DeJA VU? Sharpton demands investigation into fatal police shooting

BRONX, NEW YORK, Feb. 14- More than two dozen clergy members from across the city joined Reverend Al Sharpton as he stood with family members of Ramarley Graham, the Wakefield teen shot dead by an NYPD officer, outside Bronx District Attorney Robert Johnson's office  demanding an investigation surrounding the shooting and information on the officers involved.
During the demonstration held outside Johnson's office on Feb. 13, Sharpton, president of the National Action Network, stood side by side with Frank Graham, the boy's father, and William Bell, the father of Sean Bell, who was shot dead by police in Queens in 2006.
Graham, 18, was shot dead by an officer's bullet, inside the bathroom of his home on East 229th Street at 3 p.m. on Thursday, Feb. 2. A bag of marijuana was reportedly discovered in the toilet but Graham was unarmed during the incident.
In the brief initial statement made by the NYPD in the days after the shooting, the department stated, "Police observed a male on White Plains Road... when police approached, the individual fled into 749 E. 229th Street. Police pursued the individual into the location, where a struggle occurred on the second floor. One shot was fired by police, striking the individual in the torso."

The young man was rushed to Montefiore Hospital North on East 233rd Street, where he died a short time later.

Sharpton would tell reporters, "The attorneys revealed a tape that dispels the myth that his son was running into the house. Even if he was, you don't run behind him and break the door down and shoot him." The video shows a patrolman kicking in the front door to the home.
Speaking of the NYPD, Sharpton stated, "The code of silence must be broken," before vowing, "to do what is necessary to have an escalation of dialog because the city has to deal with this death and justice for this family."

Sharpton, who maintains that Graham was shot dead in the bathroom of the home in front of the young man's grandmother and 6-year-old brother, says the family's attorneys are calling on the Bronx District Attorney to conduct an investigation, but are also calling on the U.S. Attorney to conduct an independent investigation. Sharpton is also calling for the release of additional information on the shooting, the names of the officers involved, and their backgrounds.

After several other speakers, Sharpton again took to the microphones, adding, "This case will be the case that we can determine where this city is going. We intend to stand with this family, and it's unthinkable to me that a young man could be killed in the bathroom of his own house. They had no regard for his family members or a child being traumatized, and no regard for his grandmother who they held and questioned. This level of insensitivity calls for citywide reaction."

Taking questions from reporters, Sharpton then stated, "I think it's very significant that they (officers) not only seemed casual, but that police, without any call for backup, without any calls that there's a problem, would literally break into the house... then enter the apartment and then kill somebody."

Explaining his feelings after seeing the video obtained by the Graham family attorneys and released to the media, Sharpton stated, "This appears to be some premeditated thought that we'll just go ahead anyhow and not even consider the rights of any of the people."
  
Reacting to a comment by Johnson stating that his office would not be pressured into an investigation, Sharpton told reporters, "No one is trying to pressure anyone."

Asked about the changes that have been implemented since the shooting of Amadou Diallo a decade earlier during the then-mayor Rudolph Giuliani administration and the current Michael Bloomberg era, Sharpton replied, "The difference is the attitude, but the results are the same. We don't need to be treated better in conversation if it doesn't translate to the police at the bottom."
   
The two officers involved, who have been identified in published reports, have been placed on administrative duty pending the NYPD investigation.

The NYPD is also dealing with another disturbing video, the January 26 beating of Jateik Reed, 19, which shows the young man on the ground as a patrolman from the 42nd Precinct is seen kicking him several times in the face. The four officers in that case have also been placed on restricted duty.

The two cases come on the heels of a decision by the Manhattan District Attorney's office to not proceed with the prosecution of Greg Kelly, the 'Good Day New York' co-host and son of NYPD Police Commissioner Ray Kelly, who was accused of rape, due to inconsistency's in the woman's story. 

Many political insiders say Kelly remains a frontrunner to replace Bloomberg when he leaves office at the end of next year.

The NYPD had no immediate reply to Sharpton's comments and the Bronx District Attorney's office was closed for Presidents Day.
